Terms of Service

The basics

These terms are an agreement between you and 1Retro, LLC, a California limited liability company that operates 1Retro (referred to here as "1Retro," "we," or "us"). By creating an account or using the service, you agree to them. If you don't agree, please don't use 1Retro. They work alongside our Privacy Policy and Refund Policy.

What 1Retro is

1Retro is a service for backing up, syncing, and managing your retro game save files (and related data) across your devices. Some features are free, and some are part of a paid subscription. What's included in each plan is listed on our pricing page.

Your account

You need an account to use 1Retro. Keep your login details secure, give us accurate information, and you're responsible for what happens under your account. You must be old enough to agree to these terms in your country (at least 13, and older where local law requires it). One account is meant for one person.

Your saves are yours

You own the files and data you upload. We don't claim ownership of them and we don't sell them. You give us permission to store and process your content only as far as we need to run the service for you, such as syncing across devices, reading metadata from your saves, and keeping backups. That's it, and it's covered in more detail in our Privacy Policy.

Use it responsibly

1Retro is for managing your own files. You're responsible for the content you upload and for having the right to store it. In particular, please don't:

• • Upload or share content you don't have the rights to, or use 1Retro to distribute copyrighted games or other material to other people.
• • Use the service for anything illegal, or to store illegal content.
• • Try to break, overload, reverse-engineer, or gain unauthorized access to the service, or resell it as your own.

Subscriptions and billing

Paid plans are sold and processed by our reseller and merchant of record, Paddle, which also handles tax. Prices are shown on the pricing page. Subscriptions renew automatically at the end of each billing period until you cancel, and you can cancel anytime from your account or the Paddle customer portal. When you cancel, you keep your paid features until the end of the period you've already paid for. Refunds follow our Refund Policy. If we change our prices, we'll give you reasonable notice before it affects you.

Keep your own backups

We work hard to keep 1Retro running and your saves safe, and it's literally a backup service. But we provide it "as is," without guarantees that it will always be available or error-free, so please keep your own copies of anything you can't afford to lose. We're not responsible for lost data.

Liability

To the fullest extent the law allows, 1Retro isn't liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the three months before the issue arose. Nothing in these terms limits rights you have under consumer law that can't be limited.

Ending things

You can delete your account at any time, and we delete your data when you do, as described in our Privacy Policy. We may suspend or close an account that breaks these terms or puts the service or other people at risk.

Changes

We may update the service and these terms over time. If we make a significant change, we'll let you know. Continuing to use 1Retro after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and any disputes will be handled in the state or federal courts located in Santa Clara County, California. This does not remove any protection you have under the mandatory consumer laws of the country you live in.
